Is it a federal offense for her to throw away my mail?

she could just say she never saw it. If she admits she threw it out she could say that she had no pre arrangement to keep it. You could only sue her if she admits to throwing it out and you have a signed letter that states a contract that she will keep your mail for you. Legally at the moment she can throw it out but shes not allowed to open it.
